Chứng chỉ hành nghề Y khoa – Giải nghĩa Công văn 787/BYT-KCB và thông tư 21
Những băn khoăn về chứng chỉ hành nghề Y khoa các chuyên khoa ngoài Nội Ngoại Sản Nhi của các bác sĩ đã phần nào được giải đáp nhưng không ít bác sĩ , các viện hay Sở Y tế vẫn còn bối rối với Công văn 787/BYT-KCB, chúng tôi nhận được một số hướng dẫn như sau:
Thứ nhất
Công văn này là hướng dẫn “thực hiện cấp bổ sung phạm vi hoạt động chuyên môn đối với các bác sĩ đã được cấp chứng chỉ hành nghề khám bênh, chữa bênh”. Còn cấp mới cho các bác sĩ ngoài các chuyên khoa Nội, Ngoại, Sản, Nhi (đã được quy định tại thông tư số 21/2020/TT-BYT ra ngày 30 tháng 11 năm 2020) thì vẫn chưa được thống nhất, dự kiến sẽ có sớm (sau tết Nguyên đán).
Thứ hai
Việc quy định bổ sung phạm vi hoạt động chuyên môn các chuyên khoa tại mục 1, 2.1, 2.2 là hoặc. Tức là bạn chỉ cần thỏa điều kiện của hoặc là mục này hoặc là mục kia thì bạn được bổ sung phạm vi hoạt động chuyên môn. Giễ thở hơn cho các bác sĩ nhiều nếu các bạn muốn bổ sung phạm vi hoạt động vào chứng chỉ hành nghề. Đối với các bác sĩ đã có chứng chỉ hành nghề và sau khi có thêm bằng chuyên khoa I, chuyên khoa II thì việc bổ sung được tiến hành mà không cần quan tâm đến hệ.
Thứ ba
Chứng chỉ định hướng chỉ có giá trị khi bạn bắt đầu được đào tạo trước ngày 09/07/2019. Các loại chứng chỉ, chứng nhận từ 6 tháng trở lên tùy theo từng chuyên khoa khác không phải định hướng (trừ chứng chỉ đào tạo liên tục, đây là chứng chỉ thuộc 1 ngạch khác, chỉ sử dụng để duy trì chứng chỉ hành nghề và bổ sung kiến thức y khoa liên tục) thì đều có thể chấp nhận ko quan trọng thời gian đào tạo bắt đầu từ bao giờ.
Thứ tư
Mục 2.1…(trong đó có cả…), mục 2.2….(trong đó có…) thì từ “cả” có thể được bỏ đi để tránh hiểu nhầm là bao gồm mà đổi lại là chứng chỉ định hướng cũng được chấp nhận.
Thứ năm
Khi bạn có chứng chỉ hành nghề khám chữa bệnh chuyên khoa, bạn chỉ được bổ sung phạm vi hoạt động của chuyên khoa cùng hệ (quy định tại 2.2)
Thứ sáu
Đào tạo 06 tháng ở đây là đào tạo 06 tháng theo chương trình tại các cơ sở đào tạo hợp pháp.
Thứ bảy
Khi bạn có chứng chỉ hành nghề đa khoa, bạn chỉ được bổ sung phạm vi hoạt động chuyên khoa khác mà không có thêm chứng chỉ hành nghề. (Theo MediJob chúng tôi bạn cần cân nhắc nếu muốn lấy chứng chỉ hành nghề đa khoa và đặc biệt hơn nếu các bạn muốn mở phòng khám trừ phòng khám bác sĩ gia đình.
Bạn cần đủ thời gian hành nghề cho phạm vi hoạt động chuyên môn bổ sung mới được đứng tên).
Ví dụ, ban có chứng chỉ hành nghề khám chữa bệnh Đa khoa cấp ngày 03/01/2021 và quyết định bổ sung phạm vi hoạt động chuyên môn khám bệnh chữa bệnh chuyên khoa Da liễu 03/07/2021 thì 36 tháng sau làm Da liễu liên tục đến 03/07/2024 sẽ được mở phòng khám Da liễu. Bạn sẽ được cấp 1 quyết định gọi là quyết định bổ sung phạm vi hoạt động chuyên môn (như trong lần trao đổi trước mình đã nói).
Quyết định này có giá trị tương đương với chứng chỉ hành nghề về mặt pháp lý. Nếu muốn trở thành người chịu trách nhiêm chuyên môn kỹ thuật (Mở phòng khám) có phạm vi hoạt động chuyên môn giống với phạm vi hoạt động chuyên môn đã bổ sung thì cần phải có thời gian hành nghề tối thiểu 36 tháng tính từ ngày cấp quyết định.
Thứ tám
Thông tư số 21/2020/TT-BYT ra ngày 30 tháng 11 năm 2020 về hướng dẫn thực hành để cấp chứng chỉ hành nghề khám, chữa bệnh đa khoa đối với bác sĩ đa khoa thống nhất với công văn này và đều có giá trị.
Theo đó, thông tư 21/2020/TT-BYT là hướng dẫn cho 1 bác sỹ đa khoa, hoặc y khoa (Tùy cách gọi trên bằng mới ra trường) thực hành như thế nào để sau 18 tháng được cấp chứng chỉ hành nghề với phạm vi hoạt động chuyên môn khám bệnh, chữa bệnh đa khoa (Thực hiện các kỹ thuật theo phụ lục 1 thông tư 35/2019/TT-BYT).
Sau đó nếu muốn được bổ sung thêm các chuyên khoa khác vào phạm vi hoạt động chuyên môn thì thực hiện theo điểm 1. và điểm 2.1 công văn 787. Nếu chỉ muốn thực hiện 1 hay 1 vài kỹ thuật trong chuyên khoa khác thì chỉ cần nghiên cứu điểm 3 công văn này.
Thứ chín
Vậy bạn được bổ sung bao nhiêu chuyên môn vào chứng chỉ hành nghề Y khoa hiện hữu? Bạn được bổ sung không giới hạn chuyên khoa nhưng nếu không hoạt động quá 24 tháng chuyên khoa nào thì sẽ bị thu hồi chuyên khoa đó.
