Bệnh viện không giải quyết đơn xin nghỉ việc của bác sĩ dù quá hạn?
Ngày 10/09 tôi nhận được lời đề nghị hỗ trợ của một nữ bác sĩ, với nội dung: Vì hoàn cảnh thay đổi chỗ ở, ngày 09/06/2021 em đã có đơn xin nghỉ việc và sau 45 ngày thông báo nhưng viện vẫn chưa chịu giải quyết, em đã nhiều lần yêu cầu nhưng viện vẫn “chưa giải quyết” anh ạ. Vậy là ngót nghét hơn 03 tháng bệnh viện vẫn chưa phản hồi “đơn phương nghỉ việc” của bạn ấy?
Nhận thấy bệnh viện đã làm không đúng pháp luật, tôi tư vấn bạn ấy viết thư “yêu cầu” bệnh viện giải quyết nghỉ việc, viện dẫn cụ thể các điều của các Luật liên quan cũng như Hiến pháp Việt Nam, hạn cho bệnh viện phải giải quyết đơn xin nghỉ việc của bác sĩ trong vòng 1 tuần, sau đó sẽ đăng lên các mạng xã hội nếu bệnh viện không giải quyết.
Đúng như dự đoán, bệnh viện đã “im lặng” và rồi thư đã được đăng lên mạng xã hội, bệnh viện tức tốc liên hệ nữ bác sĩ và mời lên làm việc để giải quyết nghỉ việc, trong đó có yêu cầu bồi thường đào tạo 150 triệu.
Tôi lại tiếp tục tìm hiểu ra thì:
Bạn ấy ký hợp đồng có thời hạn với cơ sở 2 của bệnh viện này và thực hiện công tác đào tạo, ký cam kết bồi thường đào tạo với cơ sở 2, sau một quá trình làm việc và đào tạo tại cơ sở 2 thì được tuyển vào viên chức của cơ sở 1, trước khi ký hợp đồng với cơ sở 1 thì bạn ấy đã được chấm dứt hợp đồng ở cơ sở 2. Tại cơ sở 1 chưa thực hiện việc đào tạo nào cả.
Vậy là đã rõ:
Theo quả quyết của tôi, tất cả nhiệm vụ của bạn ấy ở cơ sở 2 đã được hoàn tất bằng quyết định chấm dứt hợp đồng, cơ sở 1 không có lý do nào yêu cầu bạn ấy bồi thường nghĩa vụ cho cơ sở 2 cả. Tìm hiểu tiếp thì tôi thấy hai cơ sở có con dấu và pháp lý hoàn toàn khác nhau (tuy là cùng 1 vị giám đốc).
Tôi tư vấn bạn ấy tiếp tục viết thư (không phải là đơn mà là thư, vì em đang đúng và bệnh viện thì sai, tôi nói với bạn ấy như vậy), trong thư lý giải toàn bộ vấn đề cho bệnh viện hiểu.
Thư gửi đầu tuần, hôm nay bạn ấy vui mừng báo với tôi và gửi cho tôi quyết định nghỉ việc, không cần bồi thường gì cả.
Bài học rút ra:
1- Đối với các bác sĩ: Các bác sĩ đừng ký hợp đồng, cam kết mà không đọc kỹ các điều khoản, đừng nhận việc bằng mọi giá, hãy trang bị cho mình một số kiến thức cơ bản về luật.
2- Về phía các đơn vị: Tôi luôn khuyên các đơn vị làm đúng luật, liêm chính, tạo môi trường thông thoáng để thu hút thay vì áp đặt. Làm được những điều này sẽ tốt cho chính đơn vị, chấp nhận quy luật tự do di chuyển và cạnh tranh của thị trường lao động để sẵn sàng có phương án bổ sung nhân sự, một khi các lãnh đạo có tư duy như vậy mới xây dựng được đơn vị phát triển bền vững.

Bây giờ XH phát triển, kênh phản biện nhiều. Các đơn vị y tế vì nhiều lý do khác nhau (bao gồm cả mâu thuẫn cá nhân) thường ban hành những văn đôi khi trái pháp luật. Câu chuyện trên là điển hình.
Yêu cầu bồi thường trên với mình chẳng có ý nghĩa gì cả. Muốn được bồi thường, họ phải có cơ sở. Không phải chỉ 1 tờ cam kết là xong.
